Client Terms of Service

Clients & consumersWho provides what?MyElitePT provides the app, AI-assisted tools, marketplace and payment infrastructure. Your selected PT is independently responsible for all human coaching, professional advice, programme approval, nutrition support they offer, appointments and client care—including where MyElitePT introduced you to that PT. MyElitePT remains responsible for its own platform obligations and nothing in these terms removes your statutory consumer rights.
1. Agreement and documents
These Client Terms form a contract between you and the MyElitePT operator identified above for access to the platform. They apply with the Privacy Policy, the package description shown at checkout, the PT’s disclosed prices, the PT’s booking and cancellation policy accepted at checkout, and any mandatory information shown before payment. Where a PT supplies human coaching, you also enter a separate coaching contract with that PT on the disclosed package terms. If wording conflicts, mandatory law prevails, followed by the checkout terms for the specific purchase, then these Client Terms.
2. Eligibility and account accuracy
You must be at least 18 to create or claim a MyElitePT account or use the signed-in app. MyElitePT does not currently offer a parent or guardian account flow. You must give accurate information, keep your login secure, use only your own account and promptly update contact, health and payment information that could affect service or safety. You are responsible for activity performed through your account unless caused by our security failure.
3. Platform and independent PT relationship
PTs using MyElitePT are independent businesses, not employees, workers, agents, partners or representatives of MyElitePT. A profile, review, badge, marketplace listing, matching result or introduction is not a guarantee, medical endorsement or promise of a particular outcome. Your PT decides whether to accept you, works within their professional scope and remains responsible for their coaching. MyElitePT is responsible for operating its own app, marketplace, payment collection and support services with reasonable care and skill.
4. Packages and service scope
Before payment, we show the monthly coaching-package price, training days, whether nutrition support is included or optional, check-in frequency, included appointment credits, booking methods and any separately purchasable one-off session or call credits. Only services expressly included in the purchased package are owed. The package explicitly named MyElitePT AI Coach and priced at £19.99 per month is the separate AI tier: it covers app access, an intake-aware AI training plan subject to an independent AI quality and safety review, AI-assisted tools, journal and progress tracking, but never includes human PT plan creation, direct PT chat, check-ins, appointments or nutrition coaching. AI Coach is bought through Apple’s in-app purchase on iPhone and through Stripe on the website. A human-coaching package is instead bought as one full Stripe payment at the total price shown; that single price includes MyElitePT platform access and the individual professional services expressly supplied by the selected PT. You are not charged a second £19.99 Apple AI Coach membership while that human-coaching package renews. MyElitePT’s separate business charges to the PT do not add a second fee to the package total shown to you.
5. Health screening, PAR-Q and medical clearance
You must answer consultation and PAR-Q questions honestly and tell your PT about relevant symptoms, diagnoses, injuries, pregnancy, medication, allergies, eating-disorder history or material changes. A PAR-Q flag may pause programme publication or participation until suitable medical clearance is provided. MyElitePT and PTs do not provide emergency or medical services. Stop activity and seek appropriate professional help for chest pain, fainting, severe breathlessness, acute injury, rapidly worsening symptoms or any emergency.
Exercise carries inherent risks including soreness, strains, falls and injury. Results differ between people and are not guaranteed. Nutrition plans and food estimates are general coaching support unless a properly qualified professional expressly provides a regulated clinical service. You remain responsible for food safety, allergies and deciding whether to follow a suggestion. A PT must not work outside their qualifications; report concerns to MyElitePT.
7. AI-assisted features
Active coached clients have access to the included client AI features, subject to consent and fair use. If the PT has an active AI Toolkit, AI may additionally create drafts and briefs for the PT, interpret permitted client context, estimate macros, suggest exercise alternatives and review programme quality. AI output can be wrong, incomplete or unsuitable and is not medical diagnosis, emergency guidance or a replacement for the PT’s professional judgment. PT-managed programmes must be reviewed and signed off by the PT before publication. You should verify food estimates and raise pain, safety or material plan concerns with your PT.
Client AI includes a monthly allowance alongside daily limits to protect service availability and sustainable pricing. Within the remaining monthly allowance, each client may currently send up to 40 AI Coach messages, request up to 16 meal-photograph estimates, make up to 48 text-meal estimates and request up to 48 activity estimates per day. These daily ceilings are not a promise of that many requests every day: longer conversations, photographs and complex requests use more of the monthly allowance. Client allowances renew on the first day of each calendar month (UTC); the separate AI Coach membership has a larger allowance. If an allowance is reached, we show when it renews. We do not automatically bill clients for extra AI use. Daily limits reset daily. MyElitePT may reasonably adjust these limits with clear notice where needed to protect service quality, safety or provider costs. Plans, journals, progress records and manual logging remain available if an AI limit is reached.
8. Your content and records
You retain ownership of content you submit. You grant MyElitePT a non-exclusive licence to host, copy, structure, analyse and display it only as reasonably needed to provide, secure, support and improve the service, subject to the Privacy Policy. You must have the right to upload content and must not place another person’s confidential, infringing or unlawful information into the service.
9. Community and communications
Direct chat is private to authorised participants, but it is not an emergency channel and response times are not guaranteed unless your package says otherwise. Community posts are visible to the relevant client community and may be moderated or removed. Do not harass, discriminate, threaten, impersonate, solicit unlawfully, publish sensitive data about others or post dangerous health claims. Transactional messages needed to operate your account are separate from optional promotional marketing consent.
10. Prices, recurring payments and taxes
Prices are shown in pounds sterling unless stated otherwise and may include coaching, a nutrition add-on and appointment credits. Subscriptions renew at the disclosed interval until cancelled. We will not charge a new price without the notice and consent required by law. You authorise the payment provider to collect disclosed recurring and one-off amounts. Your bank or payment provider may apply its own charges.
11. How money is allocated
For a human-coaching package, Stripe collects one advertised total. For a client sourced through the MyElitePT marketplace without a PT code or QR, MyElitePT retains 20% of the first successful package payment and 10% of later successful renewals; the PT receives the balance, subject to payment-processing fees, refunds, chargebacks and taxes. For a PT’s own attributable code, QR or direct client, MyElitePT takes no coaching commission: the PT receives the coaching portion, subject to those adjustments and their own FairScale business fee. FairScale does not add a charge to the client’s advertised package price. Separately purchased session credits for a MyElitePT-supplied client remain subject to the separately disclosed 20% marketplace share. These allocations do not increase the price shown to you.
If you move from an active Apple AI Coach membership to a human PT, you must cancel the Apple renewal through your Apple subscription controls. MyElitePT calculates the unused value of the current £19.99 paid period and applies it as a visible credit against the first Stripe PT-package payment. Your current Apple access is not removed before its paid-through date, but the human package and included platform access then renew together through Stripe only. A failed or abandoned Stripe checkout leaves the existing AI Coach membership unchanged.
12. Cooling-off rights
For an online service contract, a consumer normally has 14 days from the day after the contract is made to cancel without giving a reason. Tell the supplier clearly before that period ends. For MyElitePT services, email support@myelitept.app or write to the address above. For a PT coaching contract, contact that PT; you can also contact MyElitePT for help routing the request.
If you expressly request an early start, a proportionate charge for services actually supplied before cancellation applies only where the required information and request were provided. The right to cancel a service ends on full performance within that period only with your prior express request and acknowledgement. For digital content supplied immediately, loss of the cancellation right requires your express consent, acknowledgement of that loss and the required contract confirmation. Signing up or paying alone does not waive it. A genuinely date-specific leisure booking may be exempt; any applicable exception must be disclosed before booking, rather than assumed for the whole membership.
Where a statutory cancellation refund is due, we return it using the original payment method, unless you agree otherwise, without a refund fee and within the applicable legal deadline—normally 14 days after notice for services. Your statutory remedies for faulty goods, digital content or services are separate from cooling-off rights.

13. Cancelling a subscription
Apple purchases are managed through your Apple account subscriptions; refund requests can be made at reportaproblem.apple.com. Website purchases use the billing controls or Stripe portal provided for that subscription. Contact Support if you cannot access them. Deleting the app does not cancel a subscription.
You may turn off renewal through the in-app cancellation mechanism or payment portal made available to you. Unless a cooling-off or other statutory remedy applies, cancellation takes effect at the end of the period already paid for: no further renewal is charged, access continues for that paid period, and amounts already earned for that period—including MyElitePT’s platform fee and marketplace commission—are not reversed merely because renewal was cancelled. Cancellation is different from a refund.
14. Refunds and service problems
Where an immediate move to AI Coach is offered, you review the estimated coaching refund and switch terms before buying the separate monthly Apple subscription. Your PT package is not cancelled merely because you open or dismiss Apple’s purchase screen. Once payment is verified, we stop future PT renewals and move your existing account, completed intake, plans and progress to AI Coach. Human coaching and any nutrition coaching end; AI Coach is not a replacement for medical advice or supervised training.
The agreed coaching refund is calculated proportionately from the unused coaching portion of the actual paid billing period at purchase. It is returned to the original payment method, not credited against your Apple purchase. Once issued, card refunds usually appear within 5–10 working days, depending on the bank. Cancellation and refund settlement are separate: if either needs further processing, we show the status and arrange a review. Do not buy a second membership to resolve a pending switch. Outstanding appointments, separately bought session credits, disputes, previously refunded payments and changes spanning a new billing period may require Support review first. These arrangements do not limit statutory cancellation or refund rights.
AI Coach renews monthly through Apple until you cancel its renewal in your Apple subscriptions. Apple purchase refund requests use Apple’s refund process. Ending or refunding an Apple membership does not restart your previous PT subscription. Your previous PT’s private notes and direct messages are not supplied to AI Coach; necessary historic records remain subject to our retention policy.
If the app or coaching service is not supplied with reasonable care and skill, does not match material pre-contract information, is not supplied, is charged in error, or another statutory remedy applies, contact support@myelitept.app promptly. A paid human-coaching programme is normally due within five calendar days after service activation and receipt of the information needed to plan safely. If it remains unpublished after a further 48-hour grace period, MyElitePT will offer a managed review of reassignment, repeat performance, account credit or a full or proportionate refund of the undelivered coaching element, according to the circumstances and your legal rights. An approved or legally required refund may reverse the relevant MyElitePT fee and reduce or recover the PT share. No term in this agreement excludes mandatory refund, repeat-performance, price-reduction or damages rights.
15. Appointments, cancellation and no-shows
Appointments must be cancelled or rescheduled in MyElitePT so the event and credit can be audited. Each PT sets the notice period and late-cancellation credit rules for their package. A cancellation or reschedule completed before the stated deadline always returns the booking credit. The PT’s stated terms determine whether a late cancellation returns the credit. Those terms are shown before purchase and booking, accepted separately, versioned and stored with the purchase and appointment. The recorded policy applies when a client cancels or asks the PT to record a cancellation. A no-show may use the credit and allow the PT to retain their session share. If the PT cancels, MyElitePT returns the booking credit; the PT remains responsible for contacting the client, while MyElitePT also sends an in-app or push notification.
A monthly human-coaching package grants the displayed number of PT-session and/or phone/video booking credits on each billing date. Unused included credits roll into later billing periods while the same package membership remains continuously active, and older included credits are used first. Extra credits may be bought individually at the displayed PT price and are tracked separately. Credits are booking rights, not cash: they cannot be sold or transferred to another PT, and included credits expire when that coaching package ends or switches unless a mandatory legal right or expressly agreed remedy requires otherwise.
16. Failed payments, pauses and chargebacks
Failed or overdue payments may pause plans, AI, chat and booking allowances while preserving records. A pause does not automatically cancel future billing unless clearly stated. Chargebacks should be used honestly; fraudulent or abusive disputes may result in suspension. We and the PT may provide package, attendance, message and cancellation records to the payment provider to respond to a dispute.
17. Changing PT
You may choose another verified PT who has advertised current capacity. The normal default is an automatic switch at your next subscription renewal date. Platform access remains included without interruption. Your existing coaching package remains active until the end of its paid period, your existing PT keeps the coaching payment already allocated for that period and remains responsible for supplying the promised service until the effective date. The new PT’s capacity is reserved when you confirm, and their selected single-payment package begins and is charged from the displayed renewal date so you are not charged two coaching packages for the same period.
Included monthly sessions remain usable with the existing PT until the switch date and then expire with that package. They do not transfer to the new PT. Unbooked extra credits may be used before the switch or, subject to payment-provider and statutory rules, refunded to the original payment method; a refund may require reversal or recovery of the corresponding PT transfer so MyElitePT does not fund the PT’s share. Booked sessions remain governed by the package policy accepted for that booking. A switch does not remove a valid late-cancellation or no-show consequence. New credits are purchased after switching at the new PT’s displayed prices and terms.
You may request an immediate switch for safety or conduct concerns, material service failure, an unresolved payment or refund dispute, used current-period services, a failed, disputed or already-paid-out payment, or a request to limit the records transferred. MyElitePT will review those exceptional cases before changing access or money. Where service failure or another legal remedy is accepted, we may remove the old PT’s access, arrange replacement performance, refund or credit the unused coaching element, reverse or recover the relevant PT share and start the new package on an agreed date. Administrator review is not required for an ordinary renewal-date switch.
The confirmation page identifies the current and new PT, packages, prices, location, effective date, remaining credits, booked sessions, cancellation consequences and the exact records proposed for transfer. With your general transfer authorisation, MyElitePT may give the new PT your goals, consultation answers, availability, equipment, progress, programme history and relevant training records. Because PAR-Q answers, injuries, restrictions, symptoms and medical-clearance information are health data, they require a separate explicit confirmation. Your previous direct-PT chat history and the former PT’s private professional notes do not transfer automatically. Historic bookings and payment records remain restricted audit records. A switch does not create a right to erase records that must lawfully be retained, and all statutory cooling-off, refund and service-quality rights continue.
You may optionally publish a verified review of the departing PT during the switch. Reviews must be honest, based on your experience and exclude another person’s confidential or health information. A PT must not obstruct a switch, withhold records the platform is authorised to transfer, pressure you to remove a review or retaliate because you changed PT or left lawful feedback.
18. Availability and changes
The web app needs a supported, up-to-date browser and an internet connection. The iPhone app requires iOS 17 or later; the companion Watch app requires watchOS 10 or later and a compatible paired iPhone. Install available security updates. Offline access is limited to information already saved on your device; AI, payments and syncing need a connection. Compatibility requirements are also shown in the relevant app-store listing.
We may update features, models and reasonable service rules. We will give appropriate notice of material adverse changes and will not use a change clause to remove paid core services unfairly. Maintenance, third-party failure and events beyond reasonable control may temporarily affect availability. We do not guarantee uninterrupted service, but we remain responsible where the law says we are.
19. Acceptable use
You must not bypass payment or access controls, attack or reverse engineer protected systems, scrape personal data, misuse AI, upload malware, infringe rights, facilitate illegal activity or help another person do so. We may proportionately restrict or suspend access to protect users, investigate misuse, comply with law or address non-payment.
20. Intellectual property
MyElitePT owns or licenses its software, brand, interface, workflows and platform content. PTs own or license their original coaching materials, subject to the rights needed to deliver them through the app. Your limited right to use the service is personal, revocable, non-transferable and for lawful private use during your entitlement.
21. Liability and rights that remain
Nothing excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, breach of data-protection duties where it cannot be excluded, or any liability or consumer remedy that law does not allow us to limit. Subject to that, neither party is responsible for losses that were not reasonably foreseeable when the contract was made. Business-loss exclusions do not apply to consumers acting wholly or mainly outside a trade or profession.
22. Complaints, law and disputes
Send platform, payment or marketplace support requests and complaints to support@myelitept.app; coaching-quality complaints may also be sent to the PT. Use legal@myelitept.app only for formal legal notices. We will identify who is responsible and coordinate where an issue overlaps. These terms are governed by the law of England and Wales, but consumers retain mandatory protections and court rights applicable where they live. Please allow a reasonable opportunity to resolve a complaint before proceedings.
23. Ending access and surviving terms
You may stop using the service at any time. We may end access for serious or repeated breach, risk, illegality or non-payment, using proportionate notice where practicable. Payment, intellectual-property, confidentiality, dispute and record-retention provisions survive where their nature requires it. Ending access does not erase accrued rights or amounts already due.
24. Changes and renewed acceptance
We may update these Client Terms. Material changes will be dated, summarised and may require fresh acceptance before further use. A change will not retrospectively remove an accrued statutory right or rewrite a completed transaction unfairly.

Personal Trainer Platform & Marketplace Terms

Independent PT businessesYou are responsible for every client you coach.This includes clients you bring through your code or QR and clients introduced, matched or supplied by MyElitePT. MyElitePT does not become the client’s PT, employer, clinical provider or professional supervisor. You remain responsible for assessment, suitability, programme content, nutrition support you choose to offer, appointments, communications, professional boundaries, safety, safeguarding, insurance, legal compliance and the quality of your services.
1. Parties and business status
These PT Terms are a business-to-business agreement between the MyElitePT operator identified above and the individual or entity registering the PT account. You confirm that you act for purposes relating to your trade, business, craft or profession and have authority to bind the named PT business. They apply with the Privacy Policy, fee schedule, payout-provider terms and any data-processing schedule made available by MyElitePT.
2. Independent contractor relationship
You operate an independent coaching business. Nothing creates employment, worker status, partnership, franchise, fiduciary duty or general agency. You control how you coach within platform safety and service rules. You cannot bind MyElitePT, make promises on its behalf, present yourself as its employee or imply that MyElitePT clinically or professionally endorses your judgment.
3. Professional responsibility for all clients
You accept sole professional responsibility for human coaching supplied through your account, regardless of acquisition source. A MyElitePT introduction, marketplace listing, match, review, lead, payment or AI draft does not transfer responsibility to MyElitePT. You must independently assess the client, confirm the purchased scope, review consultation information and decide whether you can safely and lawfully provide the service.
4. Qualifications, insurance and permission to practise
You must maintain genuine, current qualifications appropriate to every service you advertise; public and professional liability insurance at commercially reasonable levels; any first-aid, safeguarding, facility, employer, tax, registration or local permission required; and accurate evidence if requested. You must immediately pause affected services and tell MyElitePT if a qualification, insurance policy, right to work, gym permission or professional restriction expires, is suspended or materially changes.
5. Scope of practice and referrals
You must work within your competence. Do not diagnose, prescribe treatment, represent general coaching as medical care, advise on medication, or supply regulated dietetic, physiotherapy or other clinical services without the required lawful qualification and insurance. Refer or signpost to an appropriately qualified professional when a client’s needs are outside scope. Marketplace clients receive the same standard as your own clients.
6. PAR-Q, informed consent and safety
Before publishing or delivering a programme, review the client’s goals, availability, equipment, constraints, PAR-Q answers, health information and medical-clearance status. Follow the publishing checklist and record PT sign-off. Do not override a medical-clearance flag merely to retain a sale. Maintain reasonable emergency arrangements for in-person work, inspect the environment and equipment you control, teach safe technique and respond appropriately to reported pain or adverse events.
7. AI drafts and automated tools
AI is an assistant, not the coach of record. You must review the full client context, validate every exercise, progression, substitution, load, target, contraindication, nutrition element and message before relying on or publishing it. You may not blame AI or MyElitePT for a decision you approved. Do not input client information into an unapproved external AI service. Report unsafe or materially incorrect outputs.
8. Nutrition capability
You may offer nutrition only by switching the capability on and only within your qualifications, insurance and lawful scope. When off, packages must not promise nutrition and clients must not be charged for it. When on, describe whether it is included or an add-on, the price and the exact service. General healthy-eating coaching must not be presented as clinical dietetics or treatment. You remain responsible for allergy, eating-disorder and referral safeguards relevant to your work.
9. Profile, packages and availability
Profile claims, qualifications, reviews, prices, capacity, location, equipment, availability and package descriptions must be accurate and kept current. You must honour accepted packages and cannot remove material services after payment without the client’s agreement and any required remedy. An online human-coaching package must include the genuine individual live phone/video check-in shown at purchase; it must not be a disguised sale of generic digital content. If you stop offering online support or nutrition, manage current clients fairly before changing public availability.
10. Marketplace standards and supplied clients
MyElitePT may rank, match or display eligible PTs using profile relevance, client choice, availability, capacity, reviews, programme-delivery history and operational factors. We do not guarantee leads, conversion, income or listing position. You must not provide a lower standard, delay plan work, pressure off-platform payment or discriminate because MyElitePT supplied the client. You must not use client details obtained through MyElitePT to market unrelated services without a lawful basis and required consent.
Your online marketplace capacity applies only to active clients supplied through the MyElitePT marketplace, temporary marketplace reservations and confirmed incoming marketplace switches. Clients acquired through your own PT code or QR do not consume those places and may be added separately, subject always to your professional ability to serve every client safely and properly.
10A. Founding Ambassador status
Founding Ambassador participation is invitation-only and governed by the separately accepted Founding Ambassador Agreement. Its badge identifies active participation in that programme and must not be presented as a professional qualification or a guarantee of client results. Ambassador benefits, referral rewards and content duties apply only for the dates and limits shown in the PT’s account.
11. Client contract and fulfilment
You are the supplier of the human coaching element identified at checkout. You must deliver it with reasonable care and skill, in accordance with the package, applicable law and professional standards. Keep sufficient records of plan approval, services delivered, attendance, cancellations, messages and material decisions. MyElitePT may communicate and collect payment as the platform or collection agent but does not assume your fulfilment duties.
11A. Programme-delivery deadline, grace period and marketplace consequences
A client’s first paid human-coaching programme must normally be reviewed, signed and published within five calendar days after cleared payment or service activation and receipt of the information reasonably needed to plan safely. MyElitePT may pause or adjust the deadline where client delay, a recorded medical-clearance requirement or a platform failure prevents safe completion; you must report the blocker through support before the deadline where reasonably practicable. The platform gives advance reminders at three days and one day remaining.
Once the five-day deadline is missed, a 48-hour grace period begins and new MyElitePT marketplace-client allocations to your account pause immediately until every overdue programme is published or otherwise resolved. This is not a cash fine. A programme published late creates a delivery-incident record. Two recorded incidents reduce marketplace ranking. A third or fourth incident triggers a 30-day marketplace suspension measured from the latest incident. Five incidents trigger permanent marketplace suspension, subject to MyElitePT’s review of evidence, correction of platform error and any appeal process then available. MyElitePT may apply a faster protective restriction for serious, dishonest or repeated non-delivery and may restore access where the record was wrong or exceptional circumstances justify it.
If the programme remains unpublished when the 48-hour grace period ends, the client must be offered a managed remedy review. MyElitePT may arrange prompt completion, reassignment, an account credit, or a full or proportionate refund of the undelivered coaching element as appropriate. You must cooperate with the transition and may not obstruct the client’s records or paid access. The coaching share connected with that undelivered service moves into a delivery reserve and is not payable until the service is accepted as remedied, reassigned or refunded.
12. Platform business fees and AI Toolkit
MyElitePT AI Coach is the separate £19.99 monthly digital service. It funds client app access, an intake-aware AI training plan with an independent AI quality and safety review, AI-assisted tools, journal, tracking and self-service functions. The reserved MyElitePT AI Coach package must not advertise or provide human PT plan creation, direct PT chat, check-ins, appointments or nutrition coaching. AI Coach is sold by MyElitePT through Apple on iPhone and Stripe on the website. A human-coaching package is collected as one full Stripe payment at the advertised client price. The PT is the independent supplier responsible for the genuine individual human coaching described in that package. FairScale is the separate monthly PT business fee for direct coached clients: 1% of the first £1,000 of monthly direct-client package value, 0.5% of the next £4,000 and 0.15% above £5,000. The monthly workspace fee is whichever is highest: that value calculation, £4.99, or 70p multiplied by the number of eligible active direct clients. It is £0 when none are active. These figures are compared and are not added together. FairScale is one monthly business total, not a separate client software subscription. Marketplace-supplied clients do not enter this calculation. Fees exclude your tax obligations unless stated.
For PTs accepting the instalment agreement from 16 September 2026, the monthly total is set at the first billing check or qualifying client payment of that calendar month, using the eligible clients and package values at that time. Changes after that calculation affect the next month. The first month starts when there are eligible active clients; there is no charge for earlier inactive months. Business shows the total and the figures used, including eligible Ambassador credits.
You authorise MyElitePT to collect instalments towards that total from your connected Stripe balance as client-payment funds become available. Each instalment is based on the month’s fee as a percentage of its eligible monthly package value. Small amounts may be grouped to meet Stripe’s minimum charge. If applying all available referral credit would leave less than 50p to pay, some credit is kept for a later month instead; no credit is lost. Instalments never increase the agreed monthly total. The daily billing check collects only the unpaid balance after month-end, starting on the first day of the next month, from the available Stripe balance or your authorised backup payment method. A failed collection is retried against the same unpaid amount, not a second fee. Previously accepted separate-monthly-billing agreements remain unchanged.
The 70p monthly active-client floor applies to PTs accepting this pricing version from 6 September 2026. PTs on the previously accepted 50p floor retain that rate until a separately notified change is expressly agreed. Signing in or updating your app does not change an existing 50p agreement. Any PT who accepted the earlier £1 floor receives the reduced 70p floor for future billing periods; previous invoices and acceptance records are not rewritten. Ambassador benefits and referral credits continue to apply where eligible.
The optional PT AI Toolkit costs £9.99 per PT for each monthly billing period and makes its PT-side AI tools available across that PT’s client base. It includes the usage allowance shown in Business & pricing. Toolkit activation, paid AI Boosts and enabling automatic boosts are available on the MyElitePT website through Stripe. The iPhone app provides access to an active Toolkit, usage and renewal information, and controls to stop renewal or automatic boosts; it does not sell the Toolkit or Boosts. The PT may buy a disclosed £5 AI Boost or enable automatic boosts on the website when the allowance is exhausted. Turning the Toolkit off also stops automatic boosts and schedules it to end at the current paid period; turning it back on resumes access subject to payment on the website. Client records and published plans are not removed when it ends.
If you accept cash or another approved offline method for your coaching, you must record the full amount accurately in MyElitePT, including any nutrition add-on. Your client can see the recorded amount. A later change to an advertised package price does not rewrite a confirmed cash payment. That active direct client and package value enter the next FairScale calculation. FairScale, the AI Toolkit and AI Boosts are collected from your available connected Stripe balance first and from your authorised backup business payment method only when needed. This arrangement does not let either party bypass fees, client consent, refund rights, tax records or payment-provider rules.
Refunded client payments are excluded from future uncollected instalment calculations where identified. FairScale pays for the monthly PT business service: a client refund does not automatically cancel that month’s business fee, and amounts already collected still count towards it. Any correction or refund of a FairScale invoice itself is reviewed separately; statutory rights are unchanged.
Stripe identity and payout setup is part of PT registration. Unless your workspace is expressly owner-exempt, you must keep a valid backup card linked to complete PT setup and accept new client payments. New cash payments are not currently supported. Existing payment records and any amounts already owed remain unchanged. You authorise MyElitePT to charge this card for business fees you owe when your available Stripe balance cannot cover them, including any FairScale balance due after month-end and AI Toolkit charges you have chosen. A failed payment remains payable. Adding a card alone does not start AI Toolkit or charge a fee.
A promotional campaign or discount code applies only to your client package price. You authorise MyElitePT and Stripe to apply the offer duration, package eligibility, dates and redemption limit you configure. You remain responsible for the accuracy and legality of the promotion and for honouring a valid live offer.
13. Direct clients
A client using your PT code, your QR or another attributable direct route is treated as your sourced client unless fraud or misattribution is shown. Stripe collects the full package total in one payment. MyElitePT allocates the package payment to you, less payment-processing fees, refunds, chargebacks, tax withholding and other disclosed adjustments. MyElitePT takes no percentage commission from that direct package payment. FairScale is a separate business fee and, under the instalment agreement, is collected towards the monthly total as described above.
14. MyElitePT-supplied clients
For a client sourced by MyElitePT without your code or QR, MyElitePT retains 20% of the first successful package payment. From the first renewal onward—the second successful package payment—that package commission drops to 10% of the coaching portion, so your gross package share rises from 80% in the first period to 90% on every renewal. For separate appointment or session credits bought by that sourced client, MyElitePT retains 20% and your gross share is 80%. All shares remain subject to processing fees, refunds, chargebacks, reserves, taxes and disclosed adjustments. Acquisition attribution remains attached to the client relationship unless MyElitePT corrects an error in writing.
15. Payment processing and payout account
You must maintain an eligible connected payout account, pass required identity and business checks and keep details accurate. The payment provider may impose separate terms, reserves, delays, verification, negative-balance recovery and processing fees. Payout display amounts are estimates until settlement. Eligible PT payouts are scheduled weekly, subject to the payment provider’s processing times, reserves and verification. We may withhold or delay payouts reasonably needed to address fraud, disputes, refunds, legal requirements, a provider hold or an undelivered coaching service that has passed the 48-hour programme grace period. A delivery reserve is limited to the estimated PT coaching share connected with the affected undelivered service unless a wider hold is reasonably necessary for linked refunds, chargebacks, fraud or legal risk; it is not an additional cash penalty.
16. Cancellation after a paid month begins
Turning off renewal normally takes effect at the end of the already-paid billing period. The client keeps the paid access and you remain responsible for delivering the promised coaching through that period. MyElitePT keeps the platform fee and the marketplace commission already earned for that period—20% of the coaching portion for the first successful period or 10% for a later renewal. You keep your earned share subject to delivery and adjustments. Cancellation alone does not create a pro-rata refund or undo the completed revenue split.
17. When cancellation is not enough
If you cannot or will not deliver the paid service, lose eligibility, materially breach the package or cancel the client immediately, MyElitePT may require reassignment, repeat performance, a credit, a proportionate refund or full refund. You must not use “cancel at period end” to retain payment while withdrawing current-period service. Statutory client rights and chargeback outcomes override an ordinary no-refund rule.
18. Refund allocation
Refunds are separate from cancellation. For an approved or legally required full refund, MyElitePT may reverse its relevant platform fee or commission and reverse or recover your corresponding share. For a partial refund, adjustments may be proportional or allocated to the undelivered element. The programme-delivery reserve in clause 11A may be released after accepted completion, transferred to fund reassigned coaching, or applied to the affected client’s refund or credit. Payment-provider fees may be non-returnable by the provider and allocated as disclosed or required by law. You authorise set-off against future payouts where needed to fund a refund, chargeback, dispute fee or negative balance connected to your services.
19. Chargebacks and payment disputes
You must promptly provide accurate package, delivery, attendance, cancellation and communication evidence. You are financially responsible for chargebacks, refunds and dispute losses attributable to your coaching, misleading profile, non-delivery, policy breach or fraud, except to the extent caused by MyElitePT’s platform failure or legal breach. MyElitePT controls responses submitted through its payment architecture but does not guarantee a dispute outcome.
20. Appointments, credits and no-shows
Display method-specific prices and your booking terms before purchase. You may configure your notice period and whether late client cancellations return a credit. A client cancellation or reschedule made before the deadline always returns the booking credit. Your policy must be clear, lawful and applied consistently to the version the client accepted. If you cancel, MyElitePT returns the client’s credit and you must contact the client directly; the platform notification does not replace that responsibility. If the client asks you to cancel on their behalf, record the client as the cancellation actor so their accepted policy is applied. You must record cancellations and no-shows honestly and must not mark delivered services that did not occur.
The number you enter as monthly PT-session or phone/video booking credits is granted to each client on every successful billing date. Unused included credits roll over while the same package remains continuously active, with older included credits used first. Clients may purchase additional method-specific credits individually at your displayed price. You must price and describe the package with that continuing obligation in mind; changing a package later must not be used to remove credits already validly granted.
20A. Client switches, reserved capacity and outgoing payments
A client may schedule a normal move to another verified PT at their next renewal without administrator approval. Until the effective date, you keep your allocated current-period coaching share and remain fully responsible for delivering the existing package; you must not withdraw service early, obstruct the move or delete or alter relevant records. The incoming PT’s advertised capacity is reserved immediately. At the effective date the outgoing package renewal stops and the incoming PT’s package starts as one new Stripe subscription. MyElitePT access remains uninterrupted throughout the switch and the client is not charged a separate platform subscription.
Included monthly sessions remain with the outgoing package and expire at the switch date. Extra credits never transfer as a count because PT prices differ. The client may use unbooked extra credits before the switch or request an eligible refund to the original payment method. If a refund is made after your share has been transferred, you authorise the payment provider or MyElitePT to reverse or recover the corresponding transfer, commission and processing adjustments. Booked sessions remain subject to the specific package policy accepted for that booking, and a switch cannot be used to avoid a valid late-cancellation or no-show charge.
Immediate switches require MyElitePT review where there is a safety, conduct or service-quality concern, missed programme-delivery obligation, disputed refund or payment reversal, services already used in the period, a failed, disputed or paid-out payment, or a selective-record-transfer request. Where your service failure is accepted, MyElitePT may promptly restrict your access, arrange reassignment, withhold or recover the undelivered coaching share and fund a proportionate refund, credit or replacement service. You must preserve evidence and cooperate. An ordinary client preference handled at renewal does not itself amount to misconduct.
21. Complaints and cooperation
Respond promptly and professionally to complaints. Report serious injury allegations, safeguarding concerns, fraud, regulatory contact, data incidents or credible professional misconduct connected to the platform through in-app Support or support@myelitept.app. Privacy and data-rights matters must be sent to privacy@myelitept.app. Cooperate with proportionate investigations and preserve relevant records. We may pause new assignments or payouts while a serious matter is assessed.
22. Data protection roles
MyElitePT is a controller for platform accounts, marketplace operation, security, payments, product support and purposes it determines. You are normally an independent controller for professional client records and coaching purposes you determine. Where either party processes solely on the other’s documented instructions, the MyElitePT PT Data Processing Addendum governs and is incorporated into these PT Terms. You must give required privacy information, use a valid lawful basis and special-category condition, restrict access, minimise data, respect rights, apply retention rules and notify MyElitePT without undue delay of a suspected personal-data breach affecting platform data.
23. Confidentiality and account separation
Access only clients assigned to your account and only information needed for legitimate coaching. Do not share logins, export records to unauthorised systems, discuss clients publicly or reveal health information in community chat. Keep devices and credentials secure. When a client changes PT, the platform may transfer consented goals, consultation answers, availability, equipment, progress, programme history and relevant training records. PAR-Q, injury, restriction and medical-clearance data require the client’s separate explicit health-data confirmation. Your private professional notes and the old direct-message history do not automatically pass to the incoming PT. Confidentiality continues after the coaching relationship ends, subject to lawful disclosure and record-retention requirements.
24. Marketing and communications
Service messages, booking updates and direct replies must be relevant and professional. Promotional email, SMS or similar marketing requires the consent or other lawful basis applicable to you and must include required identification and opt-out controls. MyElitePT’s collection of marketing consent for its own promotions does not automatically authorise your independent marketing.
25. Reviews and public content
Clients may leave or update a verified review, including while changing PT. Do not buy, fabricate, pressure, condition a refund on, obstruct or retaliate over reviews. MyElitePT may moderate content for authenticity, privacy, abuse and legal risk without promising to verify every statement. You may respond professionally but must not expose confidential client information. Ratings are opinion and no listing position is guaranteed.
26. Safeguarding and conduct
Maintain professional boundaries and follow applicable safeguarding duties. Do not harass, discriminate, exploit, groom, threaten, sexualise coaching contact, prescribe unlawful substances, make deceptive earnings or outcome claims, or use client vulnerability for financial pressure. Serious concerns may lead to immediate suspension and referral where lawful.
26A. Optional exercise videos
You may attach an exercise demonstration to a plan. Uploaded clips must be no longer than 30 seconds; YouTube links may be longer. Only upload or link to material you have the right to share, including any music. Obtain permission from identifiable people and the filming location where required. Do not include children, private client information, or people who have not agreed to appear.
Videos must be relevant, professional exercise demonstrations. Abusive, discriminatory, harassing, sexual, exploitative, unlawful, misleading or deliberately dangerous content is prohibited. Do not encourage unsafe challenges, illegal substance use or exercise beyond a client’s assessed ability. Explain necessary precautions and remain responsible for the suitability of your coaching.
New uploads and YouTube links are reviewed before clients can view them. Review is not clinical approval or a guarantee of safety. Plans can still be published without a video. Clients can report a video and hide it or all videos from that PT. We may investigate, decline or remove content and pause video sharing or suspend an account where appropriate. Do not retaliate against anyone raising a concern. Contact support to challenge a moderation decision.
Videos are optional and subject to library and usage limits. Keep your own originals. Removing a video does not remove the exercise. YouTube is a third-party service with its own availability, privacy terms and content controls; linked content may change after review. These rules form part of these PT terms, not a separate upload consent.
27. Taxes and business administration
You are responsible for invoices, income tax, National Insurance, VAT registration or reporting, expenses, insurance and other obligations of your business. MyElitePT does not provide tax, employment or legal advice and does not withhold tax unless legally required. Keep your own accounting records and obtain professional advice.
28. Intellectual property and licence
You retain ownership of original materials you upload and grant MyElitePT a non-exclusive licence to host, process and display them as needed to operate the service and deliver them to authorised clients. You warrant you have the necessary rights. MyElitePT owns its software, brand, interface, AI workflows and platform materials. You receive a limited, non-transferable business-use licence during your account entitlement.
29. Acceptable use and platform integrity
Do not bypass fees, divert an introduced client primarily to avoid commission, manipulate attribution, scrape data, attack systems, reverse engineer protected software, share access, upload malware, misuse AI or use the platform unlawfully. Genuine client choice to end the platform relationship is not prohibited, but deliberate fee circumvention or deceptive migration may be investigated under these terms.
30. Suspension and termination
You may cancel future renewal using the available mechanism. We may restrict listing, assignments, features, payouts or access under the programme-delivery ladder in clause 11A or for non-payment, expired eligibility, serious complaints, safety or data risk, fraud, legal requirement or material breach. Ranking reduction affects marketplace order only; temporary or permanent marketplace suspension prevents new platform-supplied allocations but does not cancel duties to current clients. Where practicable, we will give reasons and an opportunity to respond. Immediate action may be necessary to protect clients. You must continue handling active clients fairly or cooperate with a managed transition.
31. Liability and indemnity
Nothing excludes liability that law does not permit us to exclude. Subject to that, MyElitePT is not responsible for your independent professional acts, omissions, facilities, equipment, promises or client outcomes. You will indemnify MyElitePT for third-party claims, regulatory losses and reasonable costs arising from your unlawful or negligent coaching, breach of these PT Terms, inaccurate credentials, data misuse or infringement, except to the extent caused by MyElitePT. Any liability limitation applies only where it is fair, lawful and enforceable.
32. Records, audit and evidence
Keep appropriate evidence of qualifications, insurance, client consent, programme review, delivery, attendance and material safety decisions. On reasonable notice, provide evidence needed to verify marketplace eligibility, investigate a complaint, respond to a payment dispute or meet a legal duty. Requests will be proportionate and subject to confidentiality and data protection.
33. Changes to fees or terms
We may change future fees, features or these PT Terms with reasonable advance notice appropriate to the impact. A changed fee will not retrospectively alter a completed payment split. Material terms require renewed acceptance before continued use. If you do not agree, you may turn off renewal and complete or transition current obligations before the change takes effect.
34. Notices, law and disputes
Routine support and complaints go to support@myelitept.app. Formal notices may be sent to the account email or legal@myelitept.app. Keep your email current. These PT Terms are governed by the law of England and Wales and the courts of England and Wales have jurisdiction, subject to any mandatory rule that applies. The parties should first attempt good-faith resolution and may agree mediation.
35. Entire agreement and survival
These PT Terms and incorporated documents are the entire agreement about the platform and supersede prior discussions on that subject. Invalid provisions are adjusted only as needed, and the remainder continues. Payment, refund, confidentiality, data, intellectual-property, liability, dispute and record provisions survive termination where their nature requires it. No failure to enforce is a waiver.
